WITHDRAWAL INSTRUCTIONS FOR CONSUMERS

 

Right of withdrawal. Consumers have the right to withdraw from the contract within fourteen days without giving any reason in distance selling.

 

Withdrawal period. The withdrawal period is fourteen days

 

  • in the case of a contract for the delivery of goods from the day on which the consumer or a third party named by him who is not the carrier has taken possession of the goods;
  • in the case of a contract for several goods which the consumer has ordered as part of a single order and which are delivered separately, from the day on which the consumer or a third party named by him who is not the carrier has taken possession of the last goods;
  • in the case of a contract for the delivery of goods in several partial shipments or pieces, from the day on which the consumer or a third party named by him who is not the carrier has taken possession of the last partial shipment or the last piece
  • in the case of a contract for the regular delivery of goods over a specified period, from the day on which the consumer or a third party named by him who is not the carrier has taken possession of the first goods

 

To meet the withdrawal deadline, it is sufficient for consumers to send the communication exercising the right of withdrawal before the withdrawal period expires.

 

Explanation of the withdrawal. To exercise the right of withdrawal, consumers must inform the entrepreneur (Bizibits Sales GmbH, Haidfeldstrasse 33 Top 0.4., 4060 Leonding, Österreich, office@bio-stefan.at, +43 720 257442) by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of their decision to withdraw from this contract. Consumers may use the following model withdrawal form for this purpose, but it is not mandatory. Attention: no returns to the company address.

Consequences of withdrawal for goods. If consumers withdraw from a contract, the entrepreneur must refund all payments received from the consumer, including delivery costs (except for additional costs arising from the consumer choosing a type of delivery other than the cheapest standard delivery offered by the entrepreneur), without delay and no later than fourteen days from the day the notification of withdrawal from this contract is received by the entrepreneur. For this refund, the entrepreneur uses the same payment method that the consumer used in the original transaction, unless expressly agreed otherwise with the consumer; in no case will the consumer be charged fees for this refund.

The consumer must return or hand over the goods to the entrepreneur immediately and in any case no later than fourteen days from the day the consumer informs the entrepreneur of the withdrawal from this contract. The deadline is met if the consumer sends the goods before the expiry of the fourteen-day period.

The entrepreneur may refuse the refund until the entrepreneur has received the goods back or the consumer has provided proof that the consumer has sent the goods back, whichever is earlier.

The consumer is only liable for any loss in value of the goods if this loss in value is due to handling the goods beyond what is necessary to examine their condition, properties, and functioning.

The consumer bears the direct costs of returning the goods.
